The owner of VOGUE doesn’t do free promotion. A federal lawsuit has been filed against 21 Savage and Drake for allegedly deceptive marketing for their latest release “Her Loss” that debut at #1. The lawsuit before the United States District of Southern New York was filed by Advance Magazine Publishers Inc. alleges that:
“This action arises out of a widespread promotional campaign recently launched by
world-famous musical artists Drake and 21 Savage, built entirely on the use of the VOGUE marks
and the premise that Drake and 21 Savage would be featured on the cover of Vogue’s next issue
as a means of promoting Defendants’ newly released album Her Loss.”
There are 7 violations alleged in this complaint against Drake and 21 Savage with the Plaintiff asking the courts for relief of sums to exceed $4 million for the alleged use of the VOGUE mark.
“On the First, Second, Third and Fourth Claims, an award, at Plaintiff’s election, of
(i) treble Defendants’ profits from the sales of the Album and the Counterfeit Magazine, or treble
Plaintiff’s damages, whichever is greater; (ii) statutory damages of up to $4,000,000; or (iii)
Defendants’ profits and Plaintiff’s damages, increased subject to the principles of equity, in an
amount to be determined at trial.”
