The Wolf of Wall Street is the topic of a new lawsuit brought forth by Andrew Greene against Paramount Pictures. Superstar actor and film producer Leonardo DiCaprio has been ordered to give a deposition in the lawsuit. The movie has also come up in USPTO trademark opposition no. 91214649 between Noodle Time Inc. and Greenwood, MS native Benny Hodge. The Super Lawyers from Maven Intellectual Property according to court documents alleges that the BENNY HUNNA mark unfairly trades upon the BENIHANA trademarks established and significant goodwill and will cause dilution to its fame. Noodle Time Inc. contents the BENIHANA Marks are a part of the national fabric, appearing in popular television programs such as The Office, Saturday Night Live, ect., and on the big screen on 40 Year Old Virgin and Wolf of Wall Street. BENIHANA expresses that the BENNY HUNNA trademark would tarnish the reputation of the BENIHANA trademark because of the adult content and vulgar language in Benny Hunna’s music videos. The entertainment mogul rebuttals stating that the Opposer’s tarnishment argument is specious, arguing the “ Opposer’s remarks of a family oriented restaurant are tarnished by an open association with world record setting profanity, in which the Wolf of Wall Street sets the Guinness Book of World Record for saying the word f***, boarder line pornography, and enough drug use in the movie that seems to glorify addiction.” The TTAB DENIED the Motion for Summary Judgement by BENIHANA twice in respect to its likelihood of confusion and dilution claims. Before BENNY HUNNA could start his Pre Trial Disclosures the Maven IP Super Lawyers put in a Motion to Withdraw from the opposition.
